Terms of Use

In short: ThisPour uses AI to suggest a wine from a photographed wine list. It can make mistakes, so confirm with your server before ordering. It's for adults of legal drinking age, and it's provided as-is.

1. Agreement

These Terms of Use govern your use of ThisPour (the "Service"), operated by MJLukens Ventures LLC ("we," "us"). By using the Service you agree to these terms. If you don't agree, please don't use it.

2. What ThisPour does

You photograph a wine list and choose what you're looking for. An artificial-intelligence model reads the photo and suggests one wine from that list. You can also request tasting notes, which the AI summarizes from third-party websites.

3. AI recommendations are not guarantees

Recommendations are generated automatically by AI and may be wrong. The AI can misread wine names, vintages, prices, pour sizes or sections, especially from blurry, dim or angled photos.
Always confirm the wine, vintage and price with your server or the printed list before ordering. The restaurant's list and staff are the final word.
Recommendations reflect general wine knowledge and are not professional, medical or dietary advice. They do not account for allergies, sensitivities (such as to sulfites), medications or health conditions.

4. Legal drinking age and responsible drinking

The Service is intended only for adults of legal drinking age where they live (21 or older in the United States). Please drink responsibly and never drink and drive.

5. Restaurants

Unless a restaurant has expressly partnered with us, ThisPour is not affiliated with, endorsed by or sponsored by the restaurant whose list you photograph. Each restaurant is solely responsible for its wine list, prices, availability and service.

6. Tasting notes and third-party content

Tasting notes are AI-written summaries of information found on third-party websites, which are linked as sources. We don't control, verify or endorse those websites or their content, and summaries may be incomplete or inaccurate.

7. Acceptable use

Please use the Service only to get recommendations from wine lists. Don't upload photos of people or of anyone's personal information; don't attempt to disrupt, overload, reverse-engineer or scrape the Service; and don't use automated tools to send requests.

8. Ownership

The ThisPour name, logo, design, software and content are owned by MJLukens Ventures LLC and protected by intellectual-property laws. You may use the Service for your personal, non-commercial use. Restaurants and businesses that want to use ThisPour commercially should contact us.

9. Disclaimer of warranties

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including accuracy, availability, merchantability, fitness for a particular purpose and non-infringement. We may change, suspend or discontinue the Service at any time.

10. Limitation of liability

To the fullest extent permitted by law, MJLukens Ventures LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any wine purchase, meal, expense or decision made based on the Service. Our total liability for any claim relating to the Service will not exceed fifty U.S. dollars ($50).

11. Changes

We may update these terms from time to time. The effective date above shows when they last changed. Continuing to use the Service means you accept the updated terms.

12. Governing law

These terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Franklin County, Ohio.
